2) Scope and Acceptance
These Terms & Conditions (“Terms”) govern the sale of products offered on the Site to customers located in the European Union, the UK, Iceland, Norway, and Liechtenstein (collectively, “Customers” or “you”). By placing an order, you confirm that you have read and accept these Terms. For consumers, mandatory local consumer protection rules also apply in addition to French law (see Clause 20).
3) Definitions
• Products: tea, infusions, accessories, and related goods offered for sale on the Site.
• Consumer: any natural person acting for purposes outside their trade, business, craft, or profession.
• Business Day: Monday to Friday, excluding French public holidays.
4) Product Information
We take care to present accurate descriptions, ingredients, allergens, and images. Minor variations (e.g., packaging, harvest differences) may occur. Best-before dates are indicated where applicable. If you have allergies or dietary restrictions, contact us before ordering.
5) Prices & VAT
Prices are shown in [EUR] and include applicable VAT unless stated otherwise. Shipping fees and any optional services (e.g., express delivery) are shown at checkout. We may change prices at any time, but confirmed orders keep the price displayed at checkout.
6) Order Process & Contract Formation
You place Products in the basket, confirm shipping and billing details, accept these Terms, and click “Pay/Place Order”. The contract is formed when you receive our order confirmation email. We may refuse an order for legitimate reasons (fraud suspicion, abnormal quantities, supply issues).
7) Payment & Security (PSD2 / SCA)
Payment is due upon order via [Stripe/PayPal/other]. Card data is processed by our payment provider; we do not store full card details. Strong Customer Authentication (SCA) may be required under PSD2. We may run anti-fraud checks and suspend/void transactions if needed.
8) Invoicing
An electronic invoice will be provided. If you need a VAT invoice showing your VAT number, enter it at checkout.
9) Availability
Products are offered subject to stock. If a Product is unavailable after your order, we will inform you and offer a refund or an alternative.
10) Shipping, Delivery Times & Risk
We deliver to the EU/EEA & UK at the addresses indicated during checkout.

• Standard delivery times: 3–10 Business Days
• Shipping fees: calculated at checkout.
Risk of loss transfers upon delivery to you (consumer sale). Please check parcels upon receipt and note any visible damage to the carrier in writing at delivery; notify us within a reasonable time.
11) Retention of Title
Title to the Products remains with TEAPHOR until full payment has been received (French Commercial Code & EU practice). Until title passes, you shall not resell or pledge the Products.
12) Cooling-Off / Right of Withdrawal (EU/UK)
Consumers have 14 days from delivery to withdraw without giving reasons (Directive 2011/83/EU).
To exercise: inform us before the deadline (see model form in Annex A) and return the goods within 14 days of your notice.
Return conditions & exclusions (health/hygiene & perishable goods):
• Tea is a food product. For sealed items, returns are accepted only if the seal is intact.
• Once unsealed/opened, items cannot be returned for health and hygiene reasons.
• Custom or personalised items are non-returnable.
• Returns must be sent to: 112 impasse des moulins, 34080, Montpellier, France.
Refunds: We refund the Product price and the standard outbound shipping cost (not any extra express costs) within 14 days from receipt of your return or proof of shipment, using the original payment method. You bear return shipping costs unless the item is defective or we made a mistake.
13) Non-Conformity & Legal Guarantees
Your statutory rights apply in addition to our commercial policies:
Legal guarantee of conformity (EU Directive 2019/771; French Consumer Code L.217-3 et seq.):
• You are entitled to goods that conform to the contract; in case of lack of conformity, you may request repair or replacement, or failing that, price reduction or rescission, at no cost.
• The guarantee applies for 2 years from delivery (for consumers).
Under EU law, consumers benefit from a two-year legal guarantee of conformity. This guarantee applies to defects that existed at the time of delivery and become apparent within two years. For perishable goods such as tea, the guarantee does not extend beyond the indicated best-before date on the packaging.
Hidden defects (French Civil Code 1641 et seq.):
• If a hidden defect renders the Product unfit for its intended use, you may return it and obtain a refund or keep it and obtain a price reduction.
Contact us promptly with order number, photos, and a description of the issue. We will provide return instructions (prepaid where required by law).
14) Allergens, Storage & Use
Ingredients and potential allergens are indicated on the Product page/packaging. Store tea in a cool, dry place away from light and odours. If you are pregnant, nursing, on medication, or have a medical condition, consult a professional before consuming herbal products. Our Products are not intended to diagnose, treat, cure, or prevent any disease.
15) Promotions, Coupons & Gift Cards
Promotions and coupon codes are subject to specific terms shown on the Site (validity, scope, non-combinability). Gift cards (if offered) are valid for 12 months from purchase and cannot be redeemed for cash unless required by law.
16) User Accounts & Conduct
You are responsible for safeguarding your login credentials and for activities under your account. Do not misuse the Site (e.g., scraping, spamming, infringing IP, illegal resale).
17) Intellectual Property
All content on the Site (texts, photos, logos, trademarks, designs) is owned by or licensed to TEAPHOR and protected by IP laws. Any reproduction or use requires prior written permission.
18) Personal Data & Cookies

20) Governing Law & Jurisdiction
These Terms are governed by French law, without prejudice to mandatory protections provided by the consumer’s country of residence within the EU/UK. You may bring proceedings before the courts of your habitual residence or of our registered seat (Montpellier, France).
21) Force Majeure
We are not liable for non-performance caused by events beyond our reasonable control (Civil Code art. 1218), including but not limited to strikes, transport disruption, epidemics, natural disasters, or governmental measures. Performance is suspended for the duration of the event.
22) Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law. Otherwise, and to the extent permitted by law, our aggregate liability relating to a purchase is limited to the amount you paid for the order.
23) Changes to the Terms
We may update these Terms from time to time. The version applicable to your order is the one in force at the time of checkout. The current Terms are always available on the Site.
24) Severability & No Waiver
If any provision is held invalid, the remaining provisions remain in full force. Our failure to enforce a right does not constitute a waiver.
